My take on this is that those activities are protected when done in your own home with your own product for your own use. Take any one of those 3 qualifiers out, and it would be criminal activity. As a licensee, the products you refer to are regulated under the concentrate guidelines, not extractor guidelines.

WHOA! Not so fast!
That’s what I thought this morning as well. The OLCC made a typo, and instead of “Joseph City” wrote “Josephine County”.
The OLCC will be proofreading their copy in the future. This caused a huge furor this morning.

You’re talking about OHA/OMMP regulations, Michael, not OLCC.
The short end of the story is no, your 12 plants won’t be on any inspections list. You can still sell excess to dispensaries right now from your OMMP plants only, not your M91 plants. In a nutshell, the production of cannabis on RR lands is the core of the discussion. The commissioners there assert it is against their land use code to grow a farm crop on RR. RR5 is the biggest area of interest. The exception for non conforming use costs over $1500. I really wish there was a yes or no answer to this. Unfortunately there is not. The OHA wording is misleading, at best, if we are giving them the benefit of the doubt. There are currently 4 bills awaiting signature on the governor’s desk, 3 of which will have an effect on this situation. The date is May 1st for OHA grandfathering applications to be sent in. Please encourage everyone who even thinks they may qualify to apply asap.
This does not restrict your options, it ensures your rights.
Additionally, a larger number of applications for grandfathering will help our work this fall as we push to maintain patients rights. -

There is a Jackson County meeting on the topic even as I type this. More info on how they will proceed will be available soon. Jackson is unique in southern Oregon in their definitions, so no, Josephine County growers are not similarly affected. Douglas, of course, has a moratorium in effect until the election this November.
